Fulton County DA Fani Willis Ordered to Pay Over $54,000 in Attorney Fees for Open Records Violations

Fulton County District Attorney Fani Willis has been ordered to pay $54,264 in attorney fees after a judge ruled that her office violated Georgia’s Open Records Act by failing to properly respond to document requests from defense attorney Ashleigh Merchant.

The ruling stems from requests made in connection with the Georgia election interference case involving former President Donald Trump and 18 co-defendants. Merchant represents Michael Roman, a former Trump campaign and White House aide who was indicted alongside Trump.

In the court order, the judge found that Willis’ office was “openly hostile” to Merchant’s requests and handled them differently from other records requests, indicating a “lack of good faith.”

Willis now has 30 days to provide all requested records and pay the attorney fees, which reflect nearly 80 hours of work by Merchant on the matter.

The order represents another legal setback for Willis in the high-profile case. In December, the Georgia Court of Appeals disqualified her from prosecuting the matter due to the “appearance of impropriety” arising from her prior romantic relationship with Nathan Wade, a former special prosecutor on the case who resigned in October.

Willis has appealed the disqualification to the Georgia Supreme Court, arguing that no Georgia court has ever disqualified a district attorney based solely on an appearance of impropriety without an actual conflict of interest or forensic misconduct.

In a separate development, the Georgia Senate unanimously passed legislation in March that would allow counties to cover attorneys’ fees and other legal costs for defendants in cases where a district attorney is disqualified due to misconduct, provided the case is dismissed.

Merchant responded to the Friday ruling on X, stating: “Proud that we have judges willing to hold people in power accountable when they ignore the law!!!”

The ruling adds to ongoing legal challenges facing Willis’ office, including a prior open records lawsuit related to the election interference investigation.
