Chapter 4: The Agreement Her Husband Never Explained
Daniel returned to the hospital carrying a laptop, two legal folders, and an expression that made Amara sit upright before he even reached her bed.
He didn't greet her with his usual reassuring smile.
He placed the laptop on the rolling table, pulled the chair close, and asked the nurse whether they could have a few minutes of privacy.
When the door clicked shut, Amara held up her phone.
“Tell me what this means.””
Daniel studied the photograph again.
The document was old, its edges slightly yellowed. Lucas's signature appeared at the bottom, followed by a date from six months before his death. A second signature belonged to Charles Mitchell.
Between them sat a paragraph about a transfer of beneficial interest upon default.
Amara watched Daniel read it.
“Is that Lucas's signature?”” she asked.
“It resembles his signature, but I won't authenticate it from a photograph.””
“Then what is it?””
“A document that could change the direction of our investigation.””
“Daniel, please. No more careful answers. My father threw me out of his house while I was carrying his grandchild.
He tried to sell property that wasn't his. Now I find out my husband signed something with him before he died. I need to know whether Lucas was helping my father steal from me.””
Daniel closed the laptop halfway.
“I understand why you're afraid of that possibility. But a signature doesn't tell us the entire story. We need the complete agreement, its surrounding records, and evidence of what the parties intended.””
Amara looked toward the window.
Outside, late afternoon sunlight illuminated the hospital parking lot. Cars moved between rows of concrete, ordinary people came and went, and somewhere beyond the glass, the world continued as if her family hadn't just torn itself apart.
“Lucas never told me about a loan,” she said.
“Did he ever mention financial trouble?””
“No. He told me his investments were stable. He said the house was protected and that I would never have to worry about losing it.””
“Did he explain why he wanted the trust established?””
“He said he wanted our child to have a secure future.””
Daniel nodded.
“That fits with what we know about his estate planning.””
“But why sign an agreement with Charles?””
“That is precisely what we need to establish.””
Amara looked at the photograph again.
“Can my father use this to take the house?””
“Not automatically. A transfer provision may depend on specific conditions. We need to determine whether those conditions were met, whether the agreement is enforceable, and how it interacts with Lucas's later trust arrangements.””
“And if he forged something else?””
“Then the evidence will matter.””
Daniel opened his laptop and enlarged the document.
“Look at the paragraph above Lucas's signature. Can you make out the words?””
Amara leaned forward.
The photograph was blurry, but a few lines remained readable.
“Secured obligation,” she murmured.
“Default notice. Thirty days to cure.””
Daniel wrote the phrases down.
“This appears to refer to a financial obligation. It may be a security arrangement rather than a straightforward transfer. If the original agreement exists, its exact terms will be important.””
“Why would Lucas agree to secure anything for my father?””
“I don't know yet.””
Amara's eyes burned.
She remembered Lucas sitting at the kitchen island, reviewing paperwork while she prepared dinner. He used to turn documents facedown whenever she walked into the room, not because he was hiding anything, but because he knew she hated discussing work at home.
She had teased him about being married to his laptop.
He had laughed and promised that after the baby arrived, he would take a month off.
He never got that month.
A sudden, sharp ache crossed her chest.
“Maybe he knew Charles was in trouble,” she whispered.
“Maybe he was trying to save him.””
“That's possible,” Daniel said.
“But we shouldn't mistake a possibility for a fact.””
“What if Lucas put the house at risk because he trusted my father?””
“Then we examine the agreement and determine what rights it created. If Lucas made a financial decision that affected your inheritance, you deserve to understand it.””
Amara nodded slowly.
That answer hurt, but it was honest.
Daniel's phone rang. He glanced at the screen.
“It's Evelyn.””
He answered and put the call on speaker.
“Evelyn, I'm with Amara. We have a photograph of a possible agreement between Lucas and Charles. The document references a transfer of beneficial interest upon default.””
A woman's voice responded immediately.
“Do not assume that agreement controls the property. I need to see the entire document.””
“Agreed,” Daniel said.
“We're trying to establish where the original is.””
“Then we need to move quickly. Charles's attorney has requested an emergency meeting with the trustee. He's claiming that the trust was created to defeat a legitimate creditor.””
Amara's stomach tightened.
“Can he do that?”” she asked.
Evelyn paused.
“Anyone can make an allegation. Whether it survives scrutiny depends on the evidence. If Lucas knowingly pledged an asset to secure a valid debt, we need to understand that arrangement. But if the document is being used to justify an unauthorized transfer, the circumstances matter enormously.””
“Have you seen the original trust?”” Amara asked.
“Yes. I have the executed trust documents and the property records. The house was transferred into the trust before the transaction your father attempted today.””
“Then why is he claiming he can sell it?””
“Because he believes this older agreement gives him leverage. We need to determine whether it does.””
Daniel leaned closer to the phone.
“Can you check the execution dates against the trust documents?””
“I'm already doing that. I'll also contact the escrow company and demand that it preserve all communications related to the proposed sale.””
Amara swallowed.
“Evelyn, I need to know something. Did my husband ever tell you that my father was dangerous?””
There was a brief silence.
“He told me Charles was under considerable financial pressure. He was worried that your father might try to gain control over assets intended for you and your child.””
Amara's eyes filled.
“Why didn't anyone tell me?””
“Lucas asked us not to involve you unless there was a direct threat to your interests. He wanted to protect your peace during your pregnancy.””
“By keeping secrets from me?””
“His intention may have been protective,” Evelyn replied gently.
“That doesn't mean it was the right decision for you.””
Amara looked down at her hands.
For months, she had been grieving a husband she believed had left her with nothing but memories and a nursery waiting to be finished.
Now she was discovering that he had built a complicated legal structure around her future without explaining the details.
She couldn't decide whether she felt protected or betrayed.
“Can I see the complete agreement?”” she asked.
“If we obtain it, yes. And I want you to have independent advice about anything that could affect your rights.””
“Thank you.””
Evelyn continued, “There's one more issue. The proposed buyer has indicated that Charles promised delivery of the property free of any competing claims. If he knew about the trust and the restrictions, that representation could become important.””
Daniel ended the call after arranging to exchange documents.
For a while, the room remained quiet.
Then Amara said, “My father was going to sell my home to pay his debts.””
“That's what the evidence currently suggests,” Daniel replied.
“And Lucas may have known.””
“He knew your father was experiencing financial problems. We don't yet know everything he knew about this specific transaction.””
Amara turned toward him.
“I don't want you to protect me by keeping things from me. Not anymore.””
Daniel held her gaze.
“I won't conceal relevant information from you. If I can't answer a question, I'll tell you that directly.””
She nodded.
“Good.””
A nurse returned to check on her. The examination had been reassuring, but the medical team wanted to continue monitoring her for a while longer.
After the nurse left, Daniel stepped into the corridor to make another call.
Amara opened Vanessa's message again.
The photograph of Charles's handwritten note stared back at her.
*If the sale fails, use the original agreement.*
Her father hadn't been improvising.
He had prepared for the possibility that the sale might be blocked.
She enlarged the image and noticed something she hadn't seen before: a small label attached to the folder beneath the agreement.
*Mitchell Holdings — Original Security File.*
She called Daniel back into the room.
“Look at this.””
He examined the label.
“That may tell us where the original was stored.””
“Can you get it?””
“I'll ask the trustee to request preservation of the relevant company records. If the file is held by Charles or his company, we may need formal legal procedures to obtain it.””
Amara studied the document.
“There's something else. Vanessa said she took these pictures last night. Why would my father leave this out on his desk if it was so important?””
Daniel considered the question.
“Perhaps he believed no one would look at it. Perhaps he was reviewing it. Or perhaps the photograph doesn't show the full context.””
“So we can't trust anything until we see the original.””
“Exactly.””
Her phone vibrated.
An unfamiliar number appeared on the screen.
Amara hesitated before answering.
“Hello?””
A man's voice spoke.
“Ms. Mitchell, my name is Peter Lawson. I'm representing the company that intended to purchase your father's property.””
Amara sat very still.
“Why are you calling me?””
“Because my client has been informed that the transaction is suspended. We have a signed agreement, substantial costs, and a deadline that may be affected by the trust's claims.””
“I never agreed to sell the house.””
“Your father represented that you had.””
“Then he lied.””
Peter paused.
“I'm not calling to argue with you. I need to understand whether there is a legitimate dispute over the property's ownership.””
“There is a trust. My husband established it before he died.””
“I'm aware of that claim. But we have a document suggesting that your husband previously agreed to a security arrangement with Charles.””
Amara gripped the phone.
“Where did you get that document?””
“It was provided during the transaction.””
“Did you verify it?””
“We relied on the representations made to us and the documentation provided by the seller.””
“Then you should ask my father why he tried to sell property he didn't have authority to transfer.””
Peter's tone cooled.
“Ms. Mitchell, I would advise you not to make accusations before all the facts are established.””
“And I would advise you not to pressure an eight-month-pregnant woman who was just thrown out of her father's home.””
Silence.
Then Peter said, “I wasn't aware of that.””
“Now you are.””
Amara ended the call.
Daniel watched her.
“Was that the buyer's representative?””
“Yes. He has the agreement.””
“That's useful information. I'll notify Evelyn.””
Amara placed her phone on the table.
Her father had a plan, a buyer, and a document he believed could overcome the trust.
But she had something he hadn't counted on.
She was no longer willing to believe him simply because he was her father.
As Daniel gathered his papers, he received another message from Evelyn.
He read it once, then again.
“What is it?”” Amara asked.
“Evelyn has located a reference to the original security file in the company's records.””
“Where?””
Daniel turned the laptop toward her.
The record listed a storage location and a transfer date.
The file had been moved from Mitchell Holdings to a private attorney's office eleven days before Lucas died.
And the attorney's name was one Amara had never heard before.
*Richard Hale.*
Daniel's expression tightened.
“Amara, I need to know whether Lucas ever mentioned this man.””
She shook her head.
“No. Never.””
May you like
Daniel looked at the record again.
“Then we need to find him before your father does.””
